STAROBJECT S.A. LICENSE
1. License
The software and related documentation ("The Software") reffering to this License are licensed to you by Starobject S.A. This License allows you to use "The Software" on one single handheld hardware, and make copies of "The Software" for backup purposes only.
2. Restrictions
"The Software" contains copyrighted material. You may not everse engineer, decompile, or disassemble or otherwise attempt to derive the source code for "The Software" Product. The license granted under this License Agreement does not constitute a transfer or sale of any ownership rights in "The Software". Without first obtaining the express written consent of StarObject, you may not modify, network, rent, lease, loan, distribute or create derivative works based upon "The Software" in whole or in part.
3. Disclaimer of Warranty on Software
YOU AGREE THAT YOU USE "The Software" AT YOUR SOLE RISK. "The Software" ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. STAROBJECT S.A. EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. STAROBJECT DOES NOT WARRANT THAT "The Software" AND ITS SUPPORT WILL MEET YOUR REQUIREMENTS, OR THAT "The Software" WILL RUN WITHOUT INTERRUPTION AND ERROR-FREE. STAROBJECT DOES NOT WARRANTY THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED OR SUPPORT SOLVE ANY ISSUES. NO ORAL OR WRITTEN INFORMATION OR SUPPORT ADVICE GIVEN BY STAROBJECT SOFTWARE SHALL CREATE A WARRANTY OR ANYWAY INCREASE THE SCOPE OF THIS WARRANTY.
4. Limitation of Liability
IN NO CASE WILL STAROBJECT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, INCIDENTAL OR PUNITIVE DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, LOSS OF DATA OR OTHER SUCH PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF STAROBJECT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO CASE WILL STAROBJECT'S AGGREGATE LIABILIY ARISING OUT OF THIS LICENSE AGREEMENT EXCEED THE FEES ACTUALLY PAID BY YOU FOR THE SOFTWARE.
5. Termination
This License is terminated if you destroy "The Software". This License will terminate without notice from Starobject if you do not comply with this License. Upon termination, you must delete "The Software".
6. Controlling Law
This Agreement is governed by the laws of Luxembourg.
